GENERAL CONDITIONS OF SALE - INDIVIDUALS
 

Introduction
This website is the property of COIFFERBIO DISTRIBUTION in its entirety, as well as all the rights relating thereto. Any reproduction, in whole or in part, is systematically subject to the authorization of the owners. However, links such as hypertexts to the website are authorized on specific requests.
 

Article 1 - PRICES
1a The prices of our products are indicated all taxes included in euros excluding shipping and are valid as long as they are present on the screen.
1b All orders are payables in euros.
1c COIFFERBIO DISTRIBUTION reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of the registration of the orders subject to availability on this date.
1d The products remain the property of COIFFERBIO DISTRIBUTION, until full payment has been received.

Orders should be placed on the website www.rodolphe-co.com, www.coifferbio.com or by telephone on +33 9 84 55 11 34.
The photographs illustrating the products do not enter into the contractual field. If errors are introduced, in no case the responsibility of COIFFERBIO DISTRIBUTION can be engaged.

Article 3 - VALIDATION
When you click on the "validate" button after the order process, you declare that you accept it and all of these general conditions of sale fully and without reservation. The data recorded by COIFFERBIO DISTRIBUTION constitutes proof of all transactions between COIFFERBIO DISTRIBUTION and its customers and only this data is authentic in the event of a dispute between COIFFERBIO DISTRIBUTION and its customer.

Article 4 - ORDER CANCELLATION
COIFFERBIO DISTRIBUTION reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.
 

Article 5 - AVAILABILITY
In case of unavailability of a product after placing your order, we will inform you by email as soon as possible and you can then cancel your order or replace it with another.
 

Article 6 - PAYMENT
The payment of your purchases can be made by check or bank transfer provided that it is issued on a French bank by credit card with 3DSECURE, the secure solution for your online payments by credit card with the CIC bank.
 

Article 7 - SECURING
Payment by credit card is made via the secure site, a 100% secure soluion.
 

Article 8 - DELIVERY
Delivery is made by La Poste or Chronopost depending on the stock available to the company.
 

8a FREE SHIPPING
Shipping is free from 60€ (all taxes included) of purchase. It is not fixed, and may vary according to the needs of COIFFERBIO DISTRIBUTION.
 

8b DELIVERY PROBLEMS - QUALITY AND CONFORMITY OF THE PRODUCTS
You must check the conformity of the goods delivered at the time of the delivery, before signing the delivery note and indicate on the latter by hand, accompanied by your signature, any anomaly concerning the delivery (error, damaged product etc).
In the event of anomaly, COIFFERBIO DISTRIBUTION undertakes to reimburse you or to exchange the products that do not correspond to your order (defective or non-compliant), after you have notified your complaint, specifying your contact details, your invoice number, product references, on the invoice, by email or by post to:

We may ask you to return the affected products to us.
In all cases of return, it can only be accepted and the exchange or refund made for complete products, in their original condition (packaging, accessories) with the original invoice.
 

8c PACKAGE NOT RECEIVED
You have a period of 15 days after the date of receipt of your order to notify us of any problem receiving your package. Beyond this period, any claim will be considered inadmissible.
 

Article 9 - RIGHT OF CORRECTION
You have a period of 8 days from receipt to return the product that does not suit you: the price of the product(s) purchased will be refunded upon receipt by COIFFERBIO DISTRIBUTION and this within 15 days for payments by card and 30 days for paymens by check. Shipping and return costs are your responsibility.

This return can only be accepted for complete products, in their original condition (packaging, accessories) with the original purchase invoice. Items returned incomplete, damaged or soiled by the customer cannot be taken back. No cash on delivery will be accepted for any reason.

Any other use constitutes counterfeiting and is sanctioned under intellectual property unless prior authorization from COIFFERBIO DISTRIBUTION.
 

Article 12 - RESPONSIBILITY
The products offered comply with the French legislation in force and the standards applicable in France. The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are indicative. Article 13 - GUARANTEE
Products purchased on www.coifferbio.com or on www.rodolphe-co.com are entitled to the legal guarantee against hidden defects. To be able to benefit from the product guarantee, it is essential to keep the purchase invoice of the product.
Warranties do not cover:
– defects and their consequences related to use that does not comply with the use for which the product is intended (storage conditions)
– the consequences of exceeding the expiry date.
 

Article 14 - APPLICABLE RIGHT - DISPUTES
This agreement is subject to French law.
 

Article 15 - PERSONAL INFORMATION
COIFFERBIO DISTRIBUTION undertakes not to disclose to third parties the information that you communicate to us. These are confidential. They will only be used by its internal services for the processing of your order.

GENERAL CONDITIONS OF SALE - PROFESSIONAL CLIENTS

 

Article 1 - APPLICATION OF GENERAL CONDITIONS OF SALE

All orders imply the buyer's full and unreserved acceptance of these general conditions of sale. Any condition to the contrary posed by the buyer will be, in the absence of express acceptance, inopposable to the seller. The fact that the seller does not avail himself at any given time of any of the present general conditions of sale can not be interpreted as being a waiver to avail himself of any of the said conditions.

 

Article 2 - ORDERS

Orders addressed to COIFFERBIO DISTRIBUTION or its representatives imply in any case the acceptance of these general conditions of sale. It is forbidden to resell the RODOLPHE&CO products on the internet and to the professionals without requesting the written agreement to COIFFERBIO DISTRIBUTION beforehand. In case of stock shortage, no compensation can be demanded by the buyer.

COIFFERBIO DISTRIBUTION is obliged to respect the distribution policy of the brands it markets. It can not honor an order for products for which a network of authorized distributors exists and of which the buyer would not be member.

COIFFERBIO DISTRIBUTION also reserves the right not to honor all or part of an order if certain objective criteria for marketing the products sold to the end consumer (storage and demonstration conditions ensuring product integrity, advice and service to the consumers in particulair) do not appear to be insured by the buyer.

It is nevertheless recalled that COIFFERBIO DISTRIBUTION can not be held liable for any breaches by a buyer of its regulatory obligations.

 

Article 3 - EXPORT

In addition to the general conditions of sale, fully applicable to orders for export, special conditions may apply to these orders and be the subject of a dedicated contract between COIFFERBIO DISTRIBUTION and the importer (and/or its possible forwarder).

The buyer is responsible for compliance with the regulations applicable in the territory in which he intends to market the products. Deliveries are Ex Works (Incoterm EXW): the buyer bears the costs of transport, customs duties and bears the risks associated with the transport of the goods to their final destination.

 

Article 4 - CATALOGS AND PROSPECTUSES

Notices, prospectuses, leaflets, catalogs can not be considered as offers from the seller. It reserves the right to make any changes it deems necessary at any time and without obligation to modify the products previously delivered or in the course of delivery.

 

Article 5 - DELIVERY TIME

Depending on destination. They are given as an indication and do not commit COIFFERBIO DISTRIBUTION. Exceedances can not give rise to damages.

 

Article 6 - TRANSPORT

The goods travel at the risks and peril of the consignee. In case of damage, the remedies must be served to the carrier within two days by registered letter with acknowledgment of receipt and to inform the seller within the same time. Pricelist shipping may vary depending on the weight, size and destination of the shipment.

 

Article 7 - RECEIPT

Complaints concerning the non-conformity of the products delivered to the ordered products must be reported to COIFFERBIO DISTRIBUTION within a deadline of SEVEN days using the form provided for this purpose and duly informed. Applications not made in writing (mail, fax or e-mail) can not be considered. No return of goods can be made without the agreement of the seller. The return can only be accepted if reservations have been mentioned on the delivery note of the carrier.

 

Article 8 - PRICES

Prices are exclusive of taxes, departure from the company. Any new price published by COIFFERBIO DISTRIBUTION cancels and replaces the previous one. Rates are indicative and may fluctuate at any time. They do not constitute a firm offer. The invoices shall be drawn up in accordance with the legislation in force at the time of delivery. The prices in force are sent to you on request and at any time of the year.

50% of the total order value must be set when the order is placed. The remaining 50% must be set to the maximum on the day of departure of the pallet.

 

Article 9 - INVOICING AND PAYMENT

With the exception of the first order of a customer, payable in advance, the invoices are payable to 30 days after taking account of the order by telephone, fax or email. Payments to 30 days are to be paid by Euro levy (SEPA). Payments in cash can be made by credit card (Eurocard-Mastercard and Visa), by Europayment (SEPA) or by Eurovirement.

In case of cash payment (-7 days) from the date of invoice, a reduction will be deducted. Payment is considered not the delivery of the means of payment but its correct payment.

Cash payments are made by Wire transfer, Credit card (Eurocard-Mastercard or Visa (SEPA Norms + information on www.sepafrance.fr). When COIFFERBIO DISTRIBUTION has serious or particular reasons to fear payment difficulties on behalf of the customer at the date of the order, or after this order without having paid the previous order(s), COIFFERBIO DISTRIBUTION may refuse to honor the order and deliver the goods concerned.

 

Article 10 - FORFEITURE OF TERM

If, in the case of a staggered payment, the first due date is unpaid, the remaining maturities become immediately due without notice.

 

Article 11 - FAILURE TO PAY

In case of late payment, the seller may suspend the orders in progress, without prejudice to any other course of action. Any sum not paid on the due date will give rise, as of right and without prior notice, notwithstanding article 1153 of the Civil Code, to the payment of interest for late payment, the bank's base rates on the billing day, plus 5 points, the current interest from the day of the due date until payment. In addition, the purchaser will have to pay all the costs incurred for the recovery of the sums due, including all bank charges relating thereto. The cost of the Euro levies rejected is 20.90€ ex-tax per invoice rejected. Any invoices recovered by litigation department will be increased as a non-reductible penalty clause within the meaning of article 1129 of the Civil Code by an indemnity fixed at a flat rate of 15% of the amount of the invoice excluding taxes. In no case may the payments be suspended or made the subject of any compensation, without the prior written consent of the seller.

 

Article 12 - RESERVATION OF OWNERSHIP

All sales are concluded with reservation of ownership (Law n°80-335 and n°121). The transfer to the buyer of the property of the goods sold is suspended until the full payment of the price. The delivery of goods shall in no case constitute a settlement within the meaning of this clause. As a result, until they have been settled in full settlement, the goods must be returned to the seller as soon as possible at the sole expense of the buyer, upon request of the seller manifested by a registered letter with acknowledgment of receipt. The seller is authorized in case of failure of the buyer to return the goods, to make any arrangements to recover them by himself or have them recover at the expense of the buyer. The buyer bears the risk of loss or destruction of the goods; the buyer is forbidden to resell the goods delivered if he is in a state of cessation of payment or insolvency.

 

Article 13 - GUARANTEES

The information concerning the products and advice of use given are given for information purposes only and do not imply any ablogation on the part of the seller, since customers must verify the adaptation of the products to the use they make.

 

Article 14 - DIVISIBILITY

Any provision hereof found to be invalid for any reason shall not invalidate other provisions which retain full force and effect between the parties.

 

Article 15 - ASSIGNMENT OF JURISDICTION

All disputes relating to the execution or non-execution of these general conditions of sales fall under the French law in force and will be submitted to the jurisdiction of the "Tribunal de Commerce de Vannes".
